Agreement to Terms: By accessing or using GroovyPatterns.com or directly or indirectly requesting a Creative Services project, you agree to be bound by these Terms of Use, including the general GroovyPatterns.com Terms of Use and any product-specific terms incorporated herein. Please read all terms carefully. GroovyPatterns.com reserves the right to make changes to these Terms of Use, products, and services at any time without prior notice. You should review these Terms of Use each time you access the site or request services.

1. Use of Groovy Patterns Products: Groovy Patterns products, including groovy boards and designs, are to be used solely for personal or professional longarm quilting services. Reproduction of the boards or designs is strictly prohibited.

2. Custom Design Services: These terms govern the provision of design and other creative services projects (collectively, “Custom Design”) by GroovyPatterns.com. These Creative Services Terms of Use are incorporated into and made a part of the general GroovyPatterns.com Terms of Use, except as expressly modified herein.

  • Your Content: If you provide any text, images, designs, or other content for your Custom Design project, you guarantee you have the necessary rights and authority to use it and that GroovyPatterns.com’s use will not infringe any third-party rights, including trademark or copyright.

  • Groovy Patterns' Rights: You obtain no right or claim to any individual Design (or any element thereof) provided by GroovyPatterns.com. GroovyPatterns.com reserves the right to use the same or similar Designs or elements in other Custom Design projects. Except for the content you provide, all rights in all Custom Design work product, including final and draft Designs, are retained by GroovyPatterns.com.

  • Refusal or Termination: GroovyPatterns.com reserves the right to refuse any Creative Services project or terminate any project prior to completion for any reason, without liability.

  • Use of Designs for Promotion: GroovyPatterns.com may use any Designs and/or your finished Creative Services project products as samples for advertising, promotion, and internal purposes.

  • Cancellation of Projects: Projects may be cancelled within 10 days of the initial Designs being completed and placed in your account. If you do not cancel within this period, you will be deemed to have accepted the Designs, and all payments will be nonrefundable. To request cancellation, email [email address removed].

  • Your Responsibilities: You are responsible for providing necessary images or other content and for contacting GroovyPatterns.com with any changes, updates, or enhancements to the project from the date of sale.

  • Delivery Times: All delivery times are estimates, and GroovyPatterns.com is not responsible for any delays or their impact on your business.

3. Disclaimers and Limitations of Liability: GroovyPatterns.com disclaims liability for any loss, injury, cost, or damage suffered by the customer or any third party arising from the use of the Designs or any related information. GroovyPatterns.com shall not be liable for consequential, special, indirect, or incidental damages, including loss of business profits, business interruption, or loss of data, even if advised of the possibility of such damages. GroovyPatterns.com provides no warranty that any Design will not infringe the trademark or other rights of another party. It is your sole responsibility to seek legal advice on this matter.

4. Contact Information for Custom Design Requests: Please email your detailed custom design requests, including images if possible, to [email address removed]. Review these Terms of Use before emailing your request and artwork.

5. Mailing List: By joining our mailing list, you can receive periodic sales announcements and news about special promotions.

These Terms of Use establish the terms under which GroovyPatterns.com performs design and other creative services project(s)  (collectively, “Custom Design”). The general GroovyPatterns.com Terms of Use, available at www.GroovyPatterns.com. , including all product-specific Terms of Use or Terms and Conditions referred to in the general GroovyPatterns.com Terms of Use, are incorporated by reference into and made a part of these Creative Services Terms of Use, except to the limited extent that any such Terms of Use or Terms and Conditions are expressly modified below.

By directly or indirectly requesting a Creative Services project from GroovyPatterns.com, you agree to be bound by these Terms of Use. Please read them, including the general GroovyPatterns.com Terms of Use and other Terms of Use and Terms and Conditions incorporated herein, carefully. GroovyPatterns.com reserves the right to make changes to these Terms of Use and to the products and services offered by GroovyPatterns.com Custom Design at any time without prior notice. You should review these Terms of Use, and the incorporated GroovyPatterns.com Terms of Use, each time you access the Creative Services site

If you upload, email, link (directly or indirectly) or otherwise refer GroovyPatterns.com to any text, images, designs, or other content for incorporation into your Creative Services project, you unconditionally guarantee, represent and warrant that you have all appropriate and necessary right and authority to use such text, images, designs, or other content and that GroovyPatterns.com’s provision of Creative Services will not infringe any trademark, copyright, or other right of any other party.

The designs and/or written copy (collectively, “Designs”) prepared by GroovyPatterns.com for you as part of your Creative Services project may have similarities to Designs prepared by GroovyPatterns.com for other parties. You are obtaining no right or claim of any kind to any individual Design (or any element thereof) provided by GroovyPatterns.com, and GroovyPatterns.com reserves the right to use the same or similar Design or elements thereof in other Custom Design projects or otherwise for other parties in the future. Except for the specific Creative Services project content provided to GroovyPatterns.com by you, all rights in all Custom Design work product, including without limitation both final Designs and all interim and draft Designs, are retained by GroovyPatterns.com.

GroovyPatterns.com reserves the right, in GroovyPatterns.com’s sole discretion, to refuse to accept any Creative Services project or to terminate any Creative Services project prior to completion at any time and for any reason. You agree that GroovyPatterns.com shall have no liability of any kind to you or to any third party arising from such refusal or termination.

GroovyPatterns.com reserves the right to use any Designs and/or your finished Creative Services project products as sample work for advertising and promotional purposes and for internal purposes.

Projects may be cancelled within 10 days of the initial Designs being completed by the GroovyPatterns.com Creative Services team and placed in your GroovyPatterns.com account. If you do not cancel your Custom Design project within such 10-day period, you will be deemed to have accepted such Designs, and all amounts paid or payable by you for the Creative Services project will be nonrefundable.

It is your responsibility to provide images, or other content if needed to complete the project. You must contact GroovyPatterns.com with any changes, updates, or enhancements to the project you are requesting starting from the date of sale.

You must email GroovyPatterns.com at info@groovypatterns.com for any requests to cancel services.

GroovyPatterns.com disclaims and shall not be liable for any loss, injury, cost or damage suffered by customer or any third party, and shall in no event be liable for consequential, special, or indirect or incidental damages (including without limitation, damages for loss of business profits, business interruption, or loss of data), arising out of or in any way connected with the use of the Designs and any information available on or related to such Designs, and the delay or inability to use the GroovyPatterns.com site or any information, in each case even if GroovyPatterns.com has been advised of the possibility of such damages.

GroovyPatterns.com provides no warranty of any kind that any Design will not infringe, or be subject to a claim of infringing, the trademark or other rights of another party. It is solely your responsibility to obtain the advice of an attorney regarding whether any such Design is legally available for your use and does not infringe the rights of another party.

All delivery times are estimates only, and GroovyPatterns.com is not responsible for any late Custom Design projects and/or impact to customer’s business due to a late project.
